We are pleased to inform you that the Second Amended Joint Chapter 11 Plan Of Reorganization Of Rite Aid Corporation And Its Debtor Affiliates (With Further Modifications), dated as of August 15, 2024, was confirmed by the Bankruptcy Court on August 16, 2024 (the “Plan”), and became effective as of August 30, 2024 (the “Effective Date”).
More information regarding the approved Plan, the Trust Agreements and the Trust Documents discussed below can be found under the Pleadings and Important Documents tab.
The Plan allows for the creation of the Rite Aid Opioid Personal Injury Trust (the “Rite Aid PI Trust”). Additionally, for Rite Aid Neonatal Abstinence Syndrome Personal Injury Claims (“Rite Aid NAS Claims”), the Plan allows for the NAS Claims settlement funds to be deposited into the Endo NAS PI Trust for distribution.
RITE AID PI TRUST
The Plan allows for the creation of the Rite Aid PI Trust to (i) assume all liability for the Non-Nas Personal Injury Opioid Claims (“Rite Aid PI Opioid Claims”), (ii) collect distributions made on account of the Rite Aid PI Trust Share in accordance with the Rite Aid PI Trust Documents, (iii) administer the Rite Aid PI Opioid Claims, (iv) make distributions to holders of Allowed Rite Aid PI Opioid Claims in accordance with the Plan and the Rite Aid PI Trust Documents, and (v) carry out other matters as set forth in the Rite Aid PI Trust Documents.
A PI Opioid Claim means any and all present private opioid claims against any of the Debtors held by a natural person (1) who timely filed a Personal Injury Tort Claimant Proof of Claim Form (“Proof of Claim Form”) prior to the General Bar Date of January 12, 2024, and (2) listed an injury on Question 10 of the Personal Injury Tort Claimant Proof of Claim Form.
In order to be able to file a Rite Aid PI Opioid Claim, the claimant must have first filed a Proof of Claim Form against the Debtor in the Chapter 11 Bankruptcy case by the General Bar date of January 12, 2024, set by the Bankruptcy Court. However, in order to be eligible to receive funds from the Rite Aid PI Trust, the CLAIMANT MUST ALSO FILE A RITE AID PI OPIOID CLAIMANT DATA SHEET AND ANY REQUIRED DOCUMENTATION BY THE CLAIMS SUBMISSION DEADINE, WHICH IS A DATE SET BY THE TRUSTEE THAT IS 60 DAYS AFTER THE EFFECTIVE DATE, OR BY DECEMBER 18, 2024.
The Claims Submission Deadline for Rite Aid PI Opioid Claims is DECEMBER 18, 2024, as set by the Trustee with the PI Committee’s approval.
Due to the short filing period, the Trust recommends filing Rite Aid PI Opioid Claims as soon as possible to ensure that Rite Aid PI Opioid Claimants meet the Claims Submission Deadline.
For more information about Rite Aid PI Opioid Claims, including information on how to qualify, what award you may be eligible for, what forms and documentation must be submitted, and when payments may be made, please go to the Rite Aid PI Opioid Claims Tab as well as the Rite Aid PI Opioids ClaimsFAQs on the FAQs Tab.
RITE AID NAS PI CLAIMS
The Rite Aid NAS recovery was paid to the Endo PI Trust. Therefore, your NAS Rite Aid recovery will be received when you are paid in Endo, Allowed Rite Aid NAS Opioid Claims will be paid a simple pro rata share of the distributable proceeds based on the total number of timely Allowed NAS Opioid Claims submitted (the “NAS Payment Amount”). We are still receiving and reviewing NAS Claims, and the deficiency process is ongoing. As such, these estimated award amounts are subject to change, pending the completion of the deficiency process.
Based on the total number of estimated Allowed NAS Opioid Claims, the current gross NAS Payment Amount estimate prior to any admin fees, medical liens if applicable, and attorney’s fees or case expenses (if you have an attorney) is $332.83. All Allowed NAS Opioid Claimants who are deemed to have an Allowed NAS Opioid Claim are entitled to the current gross NAS Payment Amount estimate of $332.83.
As previously stated, the PI Trust is still receiving and reviewing NAS Claims and the deficiency process is ongoing. These estimated award amounts are subject to change. Now that the Trust has determined the initial estimated NAS Payment Amount, Allowed NAS Opioid Claimants must clear the lien resolution process prior to the Trust paying the Allowed NAS Opioid Claimant’s pro rata share. Please note that the government shutdown caused significant delays with the lien resolution process. These delays are outside of the control of both the PI Trust and the Lien Administrator. The Trust is actively working to pay allowed claims who have cleared the lien resolution process. We are hopeful that claims will begin being paid in the 1st quarter of 2026.
Thank you,
Ed Gentle
